These Terms apply to your use of bluelion1031.com and the forms on it, and to the emails and text messages we send. By using the website, or by signing up for our emails or text messages, you agree to these Terms. Our Privacy Policy explains how we handle personal information. If you do not agree to these Terms, please do not use the website.

Who we are

BlueLion 1031 is a trade name of Maryland First Title, Ltd. Maryland First Title, Ltd provides qualified intermediary services for Section 1031 exchanges under that name. In these Terms, "BlueLion 1031," "we," "us" and "our" mean Maryland First Title, Ltd. Our office is at 306 Crain Hwy N, Glen Burnie, MD 21061.

General information, not advice

Information on this website, and educational content in our emails and text messages, is general information about 1031 exchanges. It is not legal, tax, financial or investment advice, and it may not fit your situation. Talk with your own tax adviser and attorney before you make decisions.

Using this website, submitting a form, or contacting us by email, phone or text does not, by itself, create an attorney-client relationship with us or with any attorney.

Exchange services

We provide exchange services only under written agreements signed by the client. Those agreements govern the services and name the company or companies providing them. These Terms do not change any exchange agreement, and if the two conflict, the exchange agreement controls.

Submitting the Start My Exchange form or any other form does not start an exchange, make you a client, reserve our services, or extend any exchange deadline. Emails and text messages do not replace notices under an exchange agreement and do not change any exchange deadline. Prices and service descriptions on the website are general and are subject to the exchange agreement.

Submitting the Partner Program form does not create a partnership, agency or other agreement with us. Any partner arrangement requires a separate written agreement.

Text messaging terms

This section applies to the BlueLion 1031 text messaging program. Messages are sent by BlueLion 1031, a trade name of Maryland First Title, Ltd.

Messages you may receive

Each of our sign-up forms has two separate text message boxes. What you receive depends on which boxes you check.

• Informational messages, if you check the informational box: on the Partner Program form, messages about your sign-up and any referrals you send; on the Start My Exchange form, messages about your exchange request and, if you become a client, status updates about your own exchange.
• Marketing messages, if you check the marketing box: information about BlueLion 1031 exchange services, educational information about Section 1031 rules and deadlines, and information about the BlueLion 1031 Partner Program.
• Replies to messages you send us.

We send marketing text messages only to people who checked a marketing box.

How you sign up

• Real estate professionals can check either or both of the optional text message boxes on our Partner Program form at https://bluelion1031.com/partnerprogram/.
• People who request exchange services can check either or both of the optional text message boxes on our Start My Exchange form at https://bluelion1031.com/start-my-exchange/.

No box is checked in advance, and you can check one without the other.

Signing up for text messages is optional. It is not a condition of joining the Partner Program, using our website, becoming an exchange client, or buying any property, goods or services. We do not send text messages to phone numbers we get from lists, property listing data or other companies unless the person signs up directly.

Message frequency and cost

Message frequency varies. Message and data rates may apply.

How to stop texts

Reply STOP to any text to stop receiving texts from us. Replies such as STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE or OPTOUT also work. After you opt out, you may receive one text confirming it, and we will send no further texts unless you sign up again.

You can also opt out by calling (410) 863-1555, emailing NHenault@bluelion1031.com, or telling us in any other reasonable way. We honor opt-out requests promptly. To start receiving texts again, reply START.

Privacy and consent

• Your consent covers only text messages from BlueLion 1031. We do not transfer it to anyone else.
• We do not sell, rent or share your mobile number or text messaging consent with third parties or affiliates for marketing or promotional purposes. We share them only with service providers that help us run our text messaging program.
• Our text messages are only about BlueLion 1031 and its own services. We do not send messages for other companies, and we do not use text messages for affiliate marketing or lead generation for other companies.
• Our Privacy Policy explains how we handle text messaging information.

Other text messaging terms

• Carriers are not liable for delayed or undelivered messages.
• If you give up or change your mobile number, please reply STOP from that number first or tell us.
• We may update these text messaging terms by posting a new version on this page. We will not send you a new type of text message without your consent.

Email

If you give us your email address, we may email you about your request, our services, 1031 exchange topics and the Partner Program. You can unsubscribe from marketing emails at any time by replying to the email and asking to unsubscribe, by using the unsubscribe link if the email has one, or by contacting us. We may still email you about an exchange or another request you made.

Client portal

Exchange clients may be given access to our client portal at bluelion1031.moxo.com, which runs on a platform provided by Moxo. Your use of the portal is also subject to your exchange agreement and may be subject to the portal provider's terms. Keep your login details private, do not let anyone else use your account, and tell us right away if you think someone has used it without permission.

Using the website

You agree not to:

• use the website for anything unlawful or fraudulent;
• submit false information, or submit another person's contact information or sign them up for texts or emails without their permission;
• interfere with the website, try to get around its security, or upload harmful code; or
• use the website to collect personal information about other people.

Our content

The text, graphics, logos and other content on the website belong to us or our licensors. You may view and print pages for your own use and share links to them. Do not copy, republish or sell our content without our written permission.

Links to other websites

Our website links to websites we do not control, such as social media pages. We are not responsible for their content, terms or privacy practices.

Disclaimers

We try to keep the website accurate, but tax rules change, and we do not promise that the information is complete, current or free of errors. The website is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties about the website, express or implied, and we do not promise that it will always be available or free of harmful code.

Limitation of liability

To the extent the law allows, we and our owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the website or your reliance on its content, and our total liability for any claim relating to the website is limited to $100.

This section does not limit liability that cannot be limited by law, does not limit your rights under laws that govern text messages and telephone calls, and does not apply to services under an exchange agreement, which that agreement governs.

Indemnification

If someone brings a claim against us because you misused the website or broke these Terms, you agree to pay our reasonable costs of that claim, including reasonable attorney's fees, to the extent the law allows.

Governing law

Maryland law governs these Terms, without regard to conflict of law rules. Any dispute about these Terms or the website will be decided in the state or federal courts located in Maryland. This section does not change any governing law or dispute terms in an exchange agreement. If any part of these Terms cannot be enforced, the rest still applies.

Changes to these Terms

We may update these Terms. When we do, we will post the new version on this page and change the "Last updated" date. If you use the website after that, the updated Terms apply to that use. Changes do not apply to a dispute that arose before the change was posted, and they do not change an exchange agreement.
